Siae, fair compensation also for cell-phones and Pc

The decree Bondi extends the compensation for the copy deprived to cell-phones, decoder and computer. The Siae: "It is not a tax”.

The Siae did the promise in the half of last month and now, punctually as when it is a question of confiscating other money, it always maintains it: the fair compensation will be soon extended to Pc and cell-phones.

How much do I lend? Very much. The Minister for the Cultural Properties, Sandro Bondi, has signed on December 30 the relative decree, whose coming into effect is waited in days. The cell-phones, the computers, the readers Mp3 and the decoder will undergo then an increase of price (whose proceeds will finish in the cases of the Siae) in all that kept systems able to allow the duplication of works protected from the right of author; this is all that happens already for Cd, Dvd and rigid disks, thanks to which the Siae has extracted till now about 70 million Euro.

According to the estimate of Italian Manufacturers' Association and Assinform this number, thanks to the new decree, will manage to quadruple, reaching 300 millions: the Siae, the company that there do not like even they who it should represent, will get rich later on.

The fair compensation is not a strongly Italian trick: it has been instituted in reception of an European normativeness but, compared to other nations of the Union, it has assumed gigantic proportions. Besides it reaches now devices that nothing have to what to see with the works duplication or that I cannot be used to this reason (like the decoder with hard disk of Sky useless to reasons of piracy). Inoltre raggiunge ora dispositivi che nulla hanno a che vedere con la duplicazione di opere o che non posso essere usati a questo scopo (come i decoder con hard disk di Sky, inutili a scopi di pirateria).

The Siae has already left in fourth class in defending the new rule, underlining as not it is about tax, but author right: to the one who should not see the difference, the Siae in a sign explains that the author rights are the salary of the one who creates the works, and then it is just that he is applied to all the shapes of exploitation of the works themselves.

For this reason, according to the Society there becomes even obvious the reason for which each one should pay more than beforehand a cell-phone that it will use to take personal photos or where it will keep of the music that it will have extracted at original Cd's in his possession (for which, then, he has already paid enough).

The objections of the Siae to the one who is opposed (moreover uselessly, since the decree has already been signed) against the fair compensation are not stopped here: she remembers that the so picked up money will not be stopped in the cases of the Society, but there she will pass only, to reach then having right; the fact that really “having right”, like made to notice the majority above, they have been lamented in an open letter of not receiving the profits – used to cover the costs with management – it must have avoided. il fatto che proprio gli “aventi diritto”, come fatto notare più sopra, si siano lamentati in una lettera aperta di non ricevere gli utili – usati per coprire i costi di gestione – dev’essere sfuggito.

Absolutely, the Siae defines the fair compensation the whole contrary one to a disadvantage for the consumer, because “it allows the enjoyment for the personal use of the works at costs extremely lower compared to those of the original”.

The argument is only apparently contradictory: without fair compensation – it supports the Siae – is truth what Cd and Dvd (and any of of all that will go soon being added) would cost less, but to become personal copies would be forbidden, and then the one who wanted a backup of the own favourite songs would not have alternative as well as buying two originals: instead, thanks to the fair compensation, it can do the copy of using a support vergine (paid more than the cost of production and distribution of the own support itself to cover the unsuccessful sale with an original). invece, grazie all’equo compenso, può fare la copia da sé usando un supporto vergine (pagato più del costo di produzione e distribuzione del supporto stesso proprio per coprire la mancata vendita di un originale).

When any this was, a “memory or hard disk supplemented into a multimedia apparatus audio and portable video or other analogous devices” (like play) he will see the decree growing the own cost for 3,22 Euro if the own memorisation space will be inferior to 1 Gbyte and of a progressively greater number if the space will be a superior, up to 28,98 Euro for the devices that have more than 250 Gbyte of space.

The decree (that it is possible to find on-line in format Pdf) is very specific in defining the rate table, whose numbers clearly will go growing with the course of time.

Between three years there is provided the updating of the decree itself; in the meantime, there is instituted a “table of work” that should include “all the interested parties” to monitor the market of the devices and his evolution following the introduction of the increases.
