In appello, la Corte concede le attenuanti generiche: così scatta la prescrizione per tre tangenti. Per la quarta (Telepiù), l’assoluzione è concessa con formula dubitativa, secondo il comma 2 art. 530 cpp. La Cassazione, nell’ottobre 2001, conferma le condanne per i coimputati di Berlusconi Berruti, Sciascia, Nanocchio e Capone (dunque le tangenti sono state pagate), ma assolve Berlusconi per non aver commesso il fatto, seppur richiamando l’insufficienza di prove.

La procura ricorre in Cassazione, che all’inizio di luglio 2003 applica per la prima volta il “lodo Maccanico”, decidendo la sospensione del processo per Berlusconi.

Per i due falsi in bilancio contestati scatta la prescrizione. In appello è confermata l’assoluzione per i due primi reati; è assolto per uno dei due falsi in bilancio, per il secondo si applica l’amnistia.

Il giudice ha disposto che restino sotto processo i suoi coimputati Cesare Previti, Giovanni Acampora, Attilio Pacifico e Vittorio Metta.

Un’altra legge, il “lodo Maccanico”, votata con urgenza nel giugno 2003, impone la sospensione di tutti i processi a cinque alte cariche dello Stato, tra cui il presidente del Consiglio. Ma è stata giudicata incostituzionale dalla Corte costituzionale. Il processo è così ripreso fino alla sentenza: concesse le attenuenti generiche, il reato è prescritto. In appello, assoluzione: la corruzione c’è stata, ma Berlusconi non ha corrotto, ha solo pagato Previti…

Nel corso delle indagini è emerso anche un appunto scritto a mano, il verbale di una riunione tenutasi a Milano 2 alla presenza di Paolo Berlusconi e degli altri soci della discarica. Il foglietto parla della costituzione, attraverso false fatture, di fondi neri all’estero per oltre 10 miliardi, preparati per pagare in nero nuove discariche e tangenti ai politici. Sul foglietto sono indicate anche alcune cifre (“500 milioni”, “200 milioni”…) con accanto nomi o abbreviazioni (“Form”, “Pozzi”…). Chi è”Form”?

Fin dall’inizio ritenni di seguire gli sviluppi delle varie attività di Carboni, trattandosi di un sardo che intendeva operare in Sardegna e che peraltro mostrava di avere vari interessi e vari contatti con persone qualificate» (Testimonianza Pisanu al pm Dell’Osso).

Poi, il 6 giugno, il sottosegretario risponde in Parlamento ad alcune interrogazioni sulla situazione della banca di Calvi, dopo che erano ormai filtrate voci sulla drammatica crisi finanziaria che stava attraversando. Pisanu risponde tranquillizzando: la situazione è normale; il sottosegretario non accenna minimamente alla gravissima situazione debitoria in cui versa il Banco Andino, controllato dall’Ambrosiano.

Nonostante ciò, proprio da quel periodo in poi, Romani si fa versare dalla fallita somme tali da consentirgli non solo di recuperare i propri conferimenti, ma anzi da determinare un credito in favore di Lombardia 7 Tv Srl».
